Jessica C. McElfresh Related Seminars and Products
Founder and Principal
McElfresh Law, Inc.
Attorney Jessica McElfresh delivers the legal guidance and advocacy it takes to thrive in California’s cannabis industry. As a successful defense attorney, Jessica was at the forefront of marijuana legalization in California, and uses that passion and skill to represent people at all stages of the state’s legitimate marijuana market. From retail cannabis dispensaries, large cultivators, testing facilities, delivery services, investors, and marijuana entrepreneurs, Jessica provides individuals and cannabis businesses with what they need to flourish. This includes full service legal assistance with formation, zoning, regulatory compliance, licensing, land use, employment, and everything in between.
Why Cannabis?
Even as a young lawyer, Jessica never saw the cannabis industry as something that needed to be normalized. Instead, her work focused on highlighting how normal it already was.
She saw the government waste, how the current laws violated people’s rights, and wanted to be part of building something new.
Jessica has worked in cannabis law and policy since 2010. She focuses on local and state applications, land use, regulatory compliance, and business law. Jessica represents cannabis retailers, distributors, cultivators, manufacturers, and testing labs, as well as landlords and ancillary businesses. She has guided clients through successful applications in jurisdictions such as the City of San Diego, La Mesa, Encinitas, Lemon Grove, and the County of San Diego.
Jessica has authored or advised on nearly ten local ballot measures to regulate cannabis businesses. Successes include Measure U in La Mesa and Measure V in Lemon Grove in 2016 and Measure H in Encinitas in 2020. As part of this work, Jessica has won writs of mandate at the local and appellate level to compel local governments and registrars of voters to accept petitions and count voter signatures.
Jessica represents people facing discipline or loss of state and local licenses, particularly in the cannabis industry. She began her career in criminal defense and continues to take select cases. Jessica has unique experience with the crime-fraud exception to attorney-client privilege and the duties of an attorney under investigation or facing criminal charges.
Outside of her law practice, Jessica is an advocate for cannabis and broader drug policy reform. She is an advisory board member for A New PATH, an organization dedicated to promoting therapeutic rather than punitive drug policies. Jessica served as a consultant for the American Civil Liberties Union Foundation of Northern California about how Proposition 64 affects criminal justice reform and individual rights.
Jessica grew up in San Diego and graduated summa cum laude from Scripps College before attending the University of San Diego School of Law on a Dean’s Honor Scholarship. She is a former Chair of the International Cannabis Bar Association’s Professional Responsibility and Ethics Committee and its Continuing Legal Education Committee, and a former member of its Board of Directors. Jessica has spoken at conferences and taught continuing legal education classes for organizations and law schools including the California Lawyers Association, Practising Law Institute, International Cannabis Bar Association, San Diego County Bar Association, and University of San Diego School of Law. Her publications include “Attorney Ethics and Cannabis: Conflicts of Laws, Conflicts of Interest, and Attorney-Client Privilege for Cannabis Practitioners” (CLA Real Property Journal Vol. 38, No. 4 2020).

Of Counsel
Crown, LLP
After 20 years in the book publishing industry and ten years at the renowned intellectual property law firm Townsend and Townsend and Crew, LLP, I started my own law firm in the heart of San Francisco’s Financial District in 2009. From there, I joined forces with another boutique powerhouse IP Law firm, Crown, LLP. With Crown, I counsel a broad range of clients in owning, enforcing, protecting, and profiting from their intellectual property.
Law is my second career, and I am passionate about protecting brands and creative properties. I have extensive experience in trademark selection, clearance, prosecution, and enforcement, including handling trademark applications before the U.S. Patent and Trademark Office (USPTO), and representation in proceedings before the Trademark Trial and Appeal Board (TTAB), and Uniform Domain Name Dispute Resolution Policy panels.
As the legal cannabis industry began emerging, I was able to start at the ground floor and strategize about how to obtain federal trademark registrations for cannabis goods and services. I've positioned my work at Crown as a go-to legal resource to cannabis clients as the industry grew, helping them navigate complex legal issues, such as securing trademark protections for related goods and services. I am also very active in the battle for federal legalization, or simply a change at the United States Patent and Trademark Office, so that owners of cannabis businesses can be on the same footing as other business owners regarding their capabilities to protect their brands.
I advocate for cannabis legalization and often do pro bono work for Americans for Safe Access, International Cannabis Bar Association, Marijuana Policy Project, Origins Council, and Sweetleaf Collective. I am on the board of directors for Americans for Safe Access, an organization dedicated to bringing access to cannabis therapeutics to patients. I am also on the advisory Board for the International Cannabis Bar Association, an organization focused on raising the standard of legal services available to the cannabis industry and advocate for the lawyers’ right to represent cannabis industry participants.

Under her guidance, ASA has grown into the nation’s largest patient-centered organization dedicated to ensuring access to medical cannabis, bridging gaps in knowledge, policy, and regulation, and promoting its recognition as a legitimate medical therapy.
For more than two decades, Sherer has spearheaded successful advocacy campaigns at the local, state, federal, and international levels. Under her leadership, ASA achieved significant milestones, including establishing state medical cannabis programs, safeguarding state laws through impact litigation, ending federal interference with these programs, and securing protections for medical professionals. ASA, under Sherer’s direction, also championed the creation of the first product safety standards for the cannabis and hemp supply chain in partnership with the American Herbal Products Association and the American Herbal Pharmacopeia, removed federal barriers to research, collaborated with the World Health Organization to acknowledge the plant’s therapeutic benefits, helped change the international scheduling of cannabis in drug treaties, and provided guidance and data to the FDA toward recognizing “currently accepted medical use” for cannabis.
After several years spent advancing national medical cannabis frameworks abroad, guiding cutting-edge research initiatives, and reforming international drug policies, Sherer is returning to her role as Executive Director of ASA. She now leads a nationwide initiative—ASA’s “second act”—to fully integrate cannabis-based medicines into the U.S. healthcare system, ensuring that patient needs, rights, and outcomes remain central to this transformative era in medicine.

After nearly 10 years advocating for marijuana reform, I watched history being made in 2012 as Colorado passed the landmark Amendment 64 to legalize adult-use marijuana. 2012 was a landmark year for another reason - it's the year I became licensed to practice law.
After honing my craft representing clients in Florida for a few years, I moved to Colorado to dedicate my career to working with entrepreneurs, business owners, investors, and anyone else connected to the cannabis industry to get sound legal counsel and education on how to operate successfully and continue pushing this industry forward. In 2021, I obtained licensure in New Jersey as well, to bring our cannabis law experience and subject matter expertise to the Northeast.
?As a small business owner, I’m not immune to the frustrations and struggles you’re facing each and every day. To operate my cannabis-focused law practice, I, too, have to jump through hoops and come up against red tape when it comes to marketing and operating.
?As a result, I’ve learned that I cannot depend on search engines and ads; instead I strive to provide top-notch service to my clients, who in turn send referrals my way. I’m here to guide you through the process, educate you about your options, and help you achieve your goals.
?The cannabis industry is nuanced. There truly is no one-size-fits-all approach. Every business has a unique set of parameters affecting their situation, and deserves legal advice specific to its position.
